These Terms and Conditions define the contractual relationship between Camion Jaune and you “the customer”, as well as the conditions applicable to any purchase through the merchant site www.camionjauneparis.com, whether you are professional or private.

The acquisition of an article through this website implies your unconditional acceptance of its GTC. These terms and conditions shall prevail over all other general or special conditions not expressly approved by Camion Jaune.

Camion Jaune reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of your order or your connection on the current site.

The prices on the website Camion Jaune are in Euros (€) and include all the French taxes (TTC); VAT applicable on the day of the order.

Camion Jaune reserves the right to change prices at any time. Prices applied will be the ones in effect at the moment of registration of the order.

These prices do not include postage and packing.

Models are shipped as soon as the payment is received. The models are stored for 15 days.Make a comment on the back of the check the number of the order.

5 / Payment on removal:

Pick up at the premises of Camion Jaune in Palaiseau, no later than 15 days after the order. Of course, no shipping costs will be added.

All orders are subject to our prior approval; Camion Jaune reserves the right to refuse an order, especially regarding a previous payment dispute.

The items sold remain the property of the seller until full payment.

The personal information you give on your order is your responsibility. In case of error in the wording of your details (name, surname, street number and name, postal code, city name, telephone number or email address …), Camion Jaune cannot be held responsible for delivery failure, as well as the costs of re-delivery (which will be your responsibility).

Shipping costs, including packing costs, are charged in addition to the selling price of items and are based on the number of items ordered and the country of delivery. This amount will be provided before your order confirmation.

Risks related to transport:

Transport risks are borne by Camion Jaune, provided that you have checked the goods upon receipt in the presence of the carrier, and that you have served in writing on the voucher, if necessary, the observed reservations.

In the event that you receive defective, damaged (damaged package, already open …) or items that do not correspond to your order, you must refuse the package.

In the event you declare reservations upon receipt or that you refuse the items, you must declare to us, within 48 hours maximum, by email: contact@camionjauneparis.com or via our contact form.

In the event of a package loss during transport, the investigation time can vary between one and three weeks.

If you return the items to “Camion Jaune – 6 Parc d’Ardenay, 91120 PALAISEAU – France”, return shipping costs remain your responsibility.

Upon receipt of the returned items, Camion Jaune will proceed, depending on your choice and possibilities, to exchanging or refunding your items as described in the sections “Exchange” and “Right of withdrawal”.

The exchange of a defective or non-compliant item is almost never possible as the products offered for sale on the Camion Jaune website are unique. You can make use of your right of withdrawal and request the refund of an article, if you are not fully satisfied (see § right of withdrawal).

As an individual, in accordance with Article L.121-21 and paragraphs of the Consumer Code you have a period of 14 business days from receipt of your order to exercise your right of withdrawal – if an article does not suit you, and without having to justify reasons or to pay a penalty.

First, you must inform us (within the 14 days period mentioned above) of your intention to use this right of withdrawal, by sending a registered mail (with acknowledgment of receipt) to “Camion Jaune 6 Parc d’Ardenay, 91120 PALAISEAU – France”,  with all the information given in the Example of withdrawal form below.

The items must be returned in their original condition and complete (original packaging, accessories, labels …), protected model, at your expense, to the address: “Camion Jaune, 6 Parc d’Ardenay, 91120 PALAISEAU – France”.

Items returned incomplete, damaged or soiled will not be returned or refunded. For all referrals, it is recommended that you return with a solution to track the package. Otherwise, if the returned package does not reach Camion Jaune, it would not be possible to initiate a survey of postal services to locate it.

After receipt and acceptance of the claim, Camion Jaune will communicate by email or phone the terms of refund of the items concerned (excluding postage). In order to properly process the application, you are asked to attach a copy of the invoice.

The refund will be made by bank transfer.

In the online sales process, Camion Jaune is only bound by an obligation of means; it cannot be held liable for any damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, break of the service, or other involuntary problems.

You have a right to access, modify, rectify and delete personal data that concern you (art. 34 of the French law “Informatique et Libertés”). To exercise this right, you must apply by email.

The Camion Jaune website has been the subject of a simplified declaration to the CNIL (National Commission for Informatics and Liberties). The CNIL declaration number is indicated in the “legal notices”.

A “Cookie” allows the identification of the User of a website, the personalization of his site consultation and the acceleration of the display of the site thanks to the recording of a data file on his computer. These Terms are subject to French law.

In case of dispute, the court of Evry (Commercial Court or Tribunal de Grande Instance) is the only competent institution.

If a condition were to fail, it would be considered to be governed by the practices enforced in the distance selling sector whose companies are headquartered in France.

According to Article L152-1 of the French Consumer Code, “every consumer has the right to free use of a consumer mediator for the amicable resolution of the dispute with a professional. For this purpose, the professional guarantees the consumer the effective use of a consumer mediation system “.
